And on the other hand, the User – Client (hereinafter the User), registered on the website using a username and password, over which it has full responsibility for use and custody, being responsible for the veracity of the personal data provided to the provider.

this document, and implies that the user:

    The provider is not responsible for the consequences that may result from improper use of the products for sale on the website.

    The civil liability of FLOORBALL SHOP for the products supplied is limited to the amount thereof, the user renounces claiming any liability from the provider for any reason in any case of dissatisfaction with the products purchased on the website www.PadelPROShop.com, as well as possible failures, slow access or errors in accessing the website, including loss of data or other types of information that may exist on the computer or Red of the user who accesses the website.

If the order is to be sent to a delivery address outside the European Union, please note that VAT will be deducted when you make the purchase, or before, depending on the country to which the product is to be delivered. Please note: If the order is to be sent to a delivery address outside the EU, it may be subject to import duties and taxes, which must be paid when the shipment reaches the delivery address. The CUSTOMER will be responsible for paying these amounts corresponding to import duties and taxes. It should be noted that FLOORBALL SHOP does not have Control about these surcharges.     4. PLACING THE ORDER


    FLOORBALL SHOP has the right to change prices and correct incorrect prices on all orders as well as final sales. If a price is incorrect, this may force FLOORBALL SHOP to cancel the purchase and return the amount paid in the best way possible. This operation can be done at any time.       5. RIGHT OF WITHDRAWAL


      As provided by the Consumer Code (Legislative Decree 206/2005), you can return purchased products within 14 days of delivery of your purchase. The products must be returned undamaged and properly packaged in their original packaging along with the warranty. In this case, it will be the customer who will assume the return shipping costs.

      This right applies only in the event that the product and its original packaging can be returned in the same condition as when received. If an item is damaged in transit, FLOORBALL SHOP must be contacted within 14 days for compensation information.

          10. APPLICABLE WARRANTIES AND AFTER-SALES SERVICES


          10.1 Warranty:
          All products have a mandatory warranty period of 3 years, in accordance with the criteria and conditions described in Royal Legislative Decree 1/2007, of November 16, which approves the consolidated text of the General Law for the Defense of Consumers and Users and other complementary laws, as well as Royal Decree-Law 7/2021, of April 27, on the transposition of European Union directives on matters of competition, prevention of money laundering, credit institutions, telecommunications, tax measures, prevention and repair of environmental damage, posting of workers in the provision of transnational services and consumer protection, except in exceptional cases in which it may be of different duration. In cases of Material sports, footwear and Padel Clothing sports, the guarantee is governed by the period set by the manufacturer of said object, FLOORBALL SHOP not being the one who sets the guarantee periods.           In the event that the Warranty Law establishes that the product must be sent to the manufacturer to manage said warranty, the FLOORBALL SHOP team will tell you how to proceed via email or WhatsApp +34632911791.


          10.2 Defective products:
          In case of defective product,FLOORBALL SHOP must proceed with the repair, replacement, price reduction or termination of the contract (as applicable), procedures that will be free of charge for the user. FLOORBALL SHOP must be responsible for any lack of conformity that appears within a period set from delivery, as long as it informs FLOORBALL SHOP of the lack of conformity within a period of two months from when it became aware of it.  Regarding the return due to an error in the order by FLOORBALL SHOP, when the product does not correspond to the order, due to an error attributable to FLOORBALL SHOP, the user must notify the company by email as soon as possible; FLOORBALL SHOP will bear the costs of collecting the product sent in error and delivering the product corresponding to the order placed.


          10.3 Cases of warranty cancellation:
          The guarantee does not apply in the following cases:

          • Deterioration created by adaptations, adjustments or modifications made to a product without written agreement with the manufacturer,
          • Expenses related to maintenance, repair or replacement of parts due to normal wear,
          • Breakdowns and deterioration of Padel Accessories,
          • Deterioration created by misuse of the product, inappropriate use, failure to comply with the instructions for use regarding its use and maintenance or improper installation,
          • Damage generated by non-accredited persons or the user,
          • Damage caused by accidents, lightning, floods, fires or any other external cause that is not the responsibility of FLOORBALL SHOP.
          • Use of the product outside the family and private framework, for example, in the use Professional intensive.
          • Products already repaired by Repair Services other than FLOORBALL SHOP.

            10.4 Replacement of an irreparable product:In the event that the product is considered irreparable, cannot be repaired or the cost of the repair is disproportionate to its value, it will be replaced with another product exactly the same. If the latter is not possible, we will offer you a product with identical characteristics.


            The replacement of your product will conclude your sales contract and warranty extensions if any, since when purchasing your new product you will benefit from a new contract as it is a new purchase.


            10.5 Warranty terms:
            The periods that are distinguished in current legislation for general products are:

            • Period from its acquisition (in the case of having made the purchase in person) or possession (in the case of having made an online purchase) up to two years. Unless proven otherwise, it will be presumed that any lack of conformity that manifests itself in the two years following the delivery of the good already existed when the good was delivered.
            • Period from 2 years to 3 years of its acquisition (in the case of having made an in-person purchase) or possession (in the case of having made an online purchase). After the first period has passed, the seller may require the consumer to demonstrate that the failure existed originally.

              No more than two months should pass between the customer experiencing a problem with their product and notifying FLOORBALL SHOP, otherwise the product loses its warranty.

               


              11. DELIVERY AND CANCELLATIONS


              FLOORBALL SHOP ships worldwide. Deliveries are made in collaboration with different delivery companies. The delivery time will depend on the company in charge of making the delivery. When choosing a company, the corresponding time will appear, depending on the delivery company; this may be subject to an additional cost. For national shipments the deadline will be 24 to 48 hours, EU shipments 2 to 3 days and international shipments outside the EU 5 to 7 days. FLOORBALL SHOP is not responsible if these deadlines are not met, they are indicative deadlines.


              Delivery will be made to the address provided by the client. If the client cannot be contacted due to absence at home, the delivery will be attempted again the next business day.


              You have the right to cancel purchases and return the delivered merchandise by contacting Contact with the FLOORBALL SHOP customer service by email to the address mentioned at the top of these general contract conditions, within a maximum period of 30 days from the date of receipt of the merchandise, provided that the merchandise has not been unpacked and is in the same condition in which it was received. However, the customer will be responsible for the risk of transporting the merchandise returned to FLOORBALL SHOP.


              In cases where the CUSTOMER believes that the delivery is delayed so much that he no longer wishes to receive the order, it is his responsibility to cancel said order. In cases where the order has been shipped, the customer is obliged to receive said order. The cancellation is not valid until the customer has confirmed it with FLOORBALL SHOP, either by email or by phone. If a product has been discontinued, FLOORBALL SHOP has the right to cancel the purchase and refund the amount paid to the customer. FLOORBALL SHOP will notify the customer of any replacement or equivalent product if available.

               


              12. PRODUCT AVAILABILITY:


              There may be occasions when it is impossible to supply all products because they are not in stock or available at the time of purchase. In these cases, FLOORBALL SHOP staff will contact you. Contact with you to give you a choice between the following options:

              15. FORCE MAJEURE

               

              FLOORBALL SHOP will be exempt from liability for damages and other penalties if the performance of the contract is prevented, hindered or delayed by circumstances beyond our control.               These conditions will be governed or interpreted in accordance with Spanish legislation in that which is not expressly established. The provider and the user agree to submit any controversy that may arise from the provision of the products or services that are the subject of these Conditions, to the Courts and Tribunals of the domicile of the provider (if a legal entity) or the user (if a natural person).


              In the event that the user resides outside of Spain, the provider and the user expressly renounce any other forum, submitting to the Courts and Tribunals of the city of Madrid, Spain.
